Charlotte-Mecklenburg Police Warrant Records

The Charlotte-Mecklenburg Police Department is the main law enforcement agency for the city. CMPD no longer provides local arrest history checks or warrant checks to the public. This change came from concerns about the Federal Driver's Privacy Protection Act. People who need arrest history must now go to the Mecklenburg County Clerk of Superior Court at 832 East Fourth Street in Charlotte.

The Clerk's Office charges $25.00 for arrest history searches. You can pay with cash, certified check, or money order. The CMPD Records Division still handles police reports and incident records. You can reach them at 704-336-2839 or 704-336-2848 to ask about report copies. For direct email requests, write to CMPDPoliceRecords@cmpd.org. Some sensitive reports are only available through in-person visits at the CMPD headquarters at 601 East Trade Street in downtown Charlotte.

Warrant Procedures in Charlotte

Charlotte warrant records fall into several types. Arrest warrants are the most common. A judge or magistrate issues an arrest warrant when there is probable cause that a crime took place. Search warrants allow officers to search a specific place. Bench warrants come from a judge when someone misses a court date.

Under North Carolina General Statutes Chapter 15A, a warrant must describe the person and the charge. Once a warrant is served, officers file a return with the court. The warrant and its supporting papers then become part of the public record. Before service, warrants may be sealed to protect ongoing cases.

CMPD works with the Mecklenburg County Sheriff's Office on warrant service. The Sheriff handles jail operations, courtroom safety, civil process, and warrant execution for the county. CMPD handles patrol and criminal cases within Charlotte. This split means warrant records in Charlotte may be held by either agency depending on the stage of the case.

North Carolina Warrant Records Law

State law controls how warrant records work in Charlotte. The North Carolina Public Records Law makes most government documents open to the public. This includes warrant records once they are served and filed with the court.

The North Carolina Department of Public Safety oversees law enforcement across the state and provides resources on criminal records access.

Unserved search warrants are typically sealed under North Carolina law. This protects active investigations. Once a search warrant is served, the warrant and the affidavit become public after being returned to the clerk under N.C.G.S. Chapter 15A. Judges can also order warrants sealed to protect witnesses or informants. Charlotte residents can check with the Clerk of Court to find out if a specific warrant record is available.

Note: Active arrest warrants are usually available through the Sheriff's Office or Clerk of Court, but access may be limited if sharing the information would hurt an ongoing investigation.
